Caribbean Sprinter Takes SP Town Council to Court
Caribbean Sprinter Limited is challenging an order to stop San Pedro Town Council from forcing all water taxis out of the town core by the end of this year.
The High Court has allowed the company to pursue a judicial review of the council’s decision, made under Mayor Wally Nunez and the Trade Licensing Board.
The company claims the move is unfair and illegal after receiving a letter on August 7, 2024, stating it must relocate from the Eastern Foreshore by December 31.
It claims the decision was made without consultation and violates its legitimate expectation to continue operating from the approved location.
“There is an arguable case with a realistic prospect of success with no discretionary bar affecting the order for the impugned decisions to be judicially reviewed,” Justice Martha Alexander stated. “There is no evidence of consultation taking place prior to the relocation letter.”
The respondents argued the relocation was necessary to reduce congestion and that the company’s license was invalid due to unpaid fees. The judge rejected the claim that a letter sent to the dock’s owner about outstanding payments constituted notice to the applicant.
The court will now determine if the San Pedro Town Council and Trade Licensing Board acted legally or exceeded their authority.
