Court of Appeal Reduces Manslaughter Sentence
The Court of Appeal has reduced the prison sentence of Jose Ricardo Mendoza, ruling that the original sentence imposed for the 2018 manslaughter of his father‑in‑law was excessive and based on errors in calculation.
In a decision delivered on March 25, the appellate court allowed Mendoza’s appeal against sentence and substituted a significantly reduced term of imprisonment.
Mendoza had challenged the sentence imposed by Justice Sancroft in December 2023, arguing that it was unduly harsh. The Crown conceded during the appeal hearing on March 18 that the trial judge had erred, particularly in calculating the starting point of the sentence and the period Mendoza spent on remand.
The appellate court found that the trial judge’s starting point of 25 years’ imprisonment for manslaughter was too high and outside the appropriate range when assessed against Belizean case law. The court also determined that the remand time credited to Mendoza had been miscalculated.
Re‑exercising its sentencing discretion under the Senior Courts Act 2022, the Court of Appeal fixed a new starting point of 20 years, noting that manslaughter cases involving fatal stabbings in Belize generally fall within a 15‑to‑25‑year sentencing range. While the offence was serious, the court said it did not fall into the category of the “worst of the worst” manslaughter cases.
After considering mitigating factors specific to Mendoza, including the absence of any previous convictions, his good character, a favourable social inquiry report, his remorse, and the fact that he accompanied the victim to the hospital, the court reduced the sentence by two years, bringing it to 18 years.
A further one‑third reduction, equivalent to six years, was applied for Mendoza’s guilty plea. The court then credited him with five years, seven months and 21 days for time spent in pre‑trial custody between April 30, 2018, and December 31, 2023.
After all adjustments, Mendoza is now required to serve a remaining sentence of six years, four months and nine days, commencing from December 21, 2023, the date of the original sentencing judgment.
The case arose from an incident on April 30, 2018, at a residence in San Pedro, where Mendoza and his 57‑year‑old father‑in‑law, Gaspar Vargas, had been drinking alcohol. Following a verbal exchange, Vargas insulted Mendoza, who then stabbed him once in the abdomen. Mendoza subsequently took Vargas to the hospital, but Vargas died from internal bleeding caused by the wound.
Mendoza was initially charged with murder in September 2019. In July 2023, he indicated his intention to plead guilty to manslaughter, a plea accepted by the Crown.
